SMS Consent and AT&T Disclosure:

We may send SMS text messages to confirm appointments, send program updates, or contact you about your student's progress. By providing your phone number, you consent to receive these communications.

 

IMPORTANT: Your SMS consent and phone number are NOT shared with third parties or affiliates for marketing or promotional purposes. Your phone number is shared with AT&T only for the purpose of delivering SMS and voice calls to you. AT&T may not use your information for their own marketing purposes and must follow all applicable telecommunications laws.

 

Your phone number will only be shared with:

  • AT&T (SMS and call delivery only)

  • Our staff to contact you about your child's tutoring

  • No other vendors, third parties, or marketing partners

 

You may opt out of SMS marketing at any time by texting "STOP" to any message we send. However, we may still contact you about your active enrollment, payment issues, or urgent student-related matters.

 

5. How Do We Use Cookies and Tracking?

Our website uses cookies to remember your preferences and track how you use our services. This helps us improve our website and understand visitor behavior.

  • Student academic records: Retained indefinitely (FERPA requirement)

  • Payment records: Retained for 7 years (legal/tax requirement)

  • Marketing contacts: Retained until you opt out

 

7. How Do We Protect Your Information?

We use industry-standard security measures including:

  • Encrypted data transmission (HTTPS)

  • Secure payment processing through Stripe

  • Access controls and staff training

  • Regular security assessments

 

However, no internet transmission is 100% secure. We cannot guarantee complete protection against all unauthorized access. You use our services at your own risk.

 

8. Student Data and FERPA Compliance

FERPA (Family Educational Rights and Privacy Act) protects student educational records. Pursuant to FERPA, parent/guardians have the right to:

  • Access their child's educational records

  • Request corrections to inaccurate information

  • Restrict disclosure of records to third parties

 

We do not disclose student educational records to third parties without explicit written consent from the parent/guardian, except as permitted by FERPA (such as to school officials with legitimate educational interests). We store all student academic data in Proprietor Software, which is only accessible by GIGA staff.

9. Children and COPPA Compliance

COPPA (Children's Online Privacy Protection Act) restricts how we collect and use information from children under 13. Compliance:

 

Direct Marketing: We do NOT send marketing or promotional emails directly to children under 13.

  • All marketing communications are sent to parents/guardians only

  • Children under 13 may only receive administrative SMS or calls about their tutoring sessions

 

Student Data Collection for Tutoring: We DO collect student data (name, DOB, grade, assessment scores, progress notes) only for tutoring purposes. This is necessary to provide educational services and is not covered by COPPA restrictions on marketing.

 

Parental Consent: For students under 13, we obtain parental consent before collecting any information. Parents/guardians retain full access to all student records and can request deletion of data at any time.

 

10. Your Privacy Rights

You have the right to:

  • Access your personal information or your child's educational records

  • Request correction of inaccurate information

  • Request deletion of your information (except where we have a legal obligation to retain it)

  • Withdraw consent for marketing communications
